General Terms and Conditions of Sale (GTC)

1. Purpose

These General Terms and Conditions of Sale (GTC) govern all sales of products offered on the website www.finessementality.com (hereinafter "the Site"), property of FINESSE , registered trademark.

Any order placed on the Site implies full and complete acceptance of these Terms and Conditions by the customer.


2. Products

The products offered for sale are described as accurately as possible.
However, slight variations may exist, particularly regarding colours, due to differences in display between screens or production batches.

Some items may be available in stock or for pre-order .
The product status and applicable delivery time are clearly indicated on each product page and are binding at the time of ordering.

Each piece is produced in limited quantities, with a focus on quality and exclusivity.


3. Price

Prices are shown in euros (€), inclusive of all taxes (TTC), excluding delivery charges.
FINESSE reserves the right to change its prices at any time, without notice.
Products are billed based on the rates in effect at the time the order is validated.


4. Order

The customer can place orders directly online on the Site.
All orders imply acceptance of the prices, descriptions, delivery times and status (stock or pre-order) of the products as indicated on the product sheet.

FINESSE reserves the right to refuse or cancel any order for legitimate reasons (fraud, stock problem, prior dispute, inconsistency of information provided, etc.).


5. Payment

Payments are secure and can be made by credit card (Visa, Mastercard, American Express) or any other method offered on the Site.
The total amount of the order is debited at the time of validation, including for pre-ordered products.


6. Delivery

Delivery times – Items in stock

Items in stock are carefully prepared and shipped within the following indicative timeframes:

  • Metropolitan France: 4 to 7 business days

  • Europe: 6 to 8 business days

  • International: 7 to 11 business days

These delivery times are given as a guide and may vary depending on the carriers or exceptional periods (high traffic, weather, strikes, etc.).

Pre-orders

⚠️ The delivery times mentioned above do not apply to pre-ordered items .

Products offered for pre-order have a specific delivery time , clearly indicated on the product page , which the customer is required to check before placing an order.

By validating their order, the customer acknowledges having read and accepted the delivery time specific to the pre-order.

No refund, cancellation or compensation may be demanded solely on the grounds of a pre-order delay, when this delay was clearly indicated on the product sheet at the time of purchase, without prejudice to the legal rights of the consumer customer when applicable.

Delivery costs are specified before order confirmation.


7. You have a right to change your mind (but it is limited) – Cancellation / Returns / Exchanges

7.1 Right of withdrawal (consumer clients)

For most products purchased on the Site, you have a legal right of withdrawal allowing you to change your mind and obtain a refund of the sums paid for the product(s), including standard delivery charges (where applicable), subject to the conditions below.

7.2 Cases in which you cannot withdraw

You cannot exercise your right of withdrawal for:

  • products sealed for health protection or hygiene reasons, once unsealed after receipt;

  • sealed audio/video recordings or sealed computer software , once unsealed after receipt;

  • goods manufactured to your specifications or clearly personalized ;

  • goods which, after delivery, are inseparably mixed with other items.

7.3 Deadline for informing us (14 days)

If you wish to withdraw, you must inform us no later than 14 days after the day of delivery.
If your order is delivered in several packages on different dates, the period begins the day after the last package is received .

Please provide your order number , the product(s) concerned and a clear statement expressing your wish to withdraw.

7.5 You must return the product at your own expense (within 14 days)

You must return the Product(s) (as well as any gift offered ) within 14 days of notifying us of your withdrawal.

Returns are at your expense , unless FINESSE expressly indicated at the time of purchase that returns were free, or in the event of an error attributable to FINESSE (defective/non-compliant product, preparation error).

You can return the product via a carrier of your choice. We strongly recommend using a trackable shipping method and keeping proof of postage showing the shipping date.
Without proof of shipment, if we do not receive the package, or if it is not received within a reasonable time, no refund can be issued .

7.6 Control upon receipt and depreciation (anti-abuse)

Returned products are inspected upon receipt. If the product has been handled beyond what is necessary to verify its size/fit (e.g., marks, odors, damage, removed labels, missing accessories/packaging), FINESSE may apply a deduction corresponding to the product's depreciation , in accordance with the legal framework.

7.7 Exchanges

FINESSE accepts exchanges (especially in the case of size), subject to availability .

Terms :

  • the request must be made within 14 days of receiving the order;

  • the product must be returned in strictly new condition: unworn (except for trying on), unwashed, odorless, without any signs of use, tags attached , accessories and original packaging included;

  • The exchange is processed after receipt and inspection of the returned product.

Costs :

  • The customer is responsible for the return shipping costs of the original product, except in the case of an error attributable to FINESSE;

  • The customer is responsible for the return shipping costs of the exchanged item, except in the case of an error attributable to FINESSE.




8. Defective or non-conforming products

The products are covered by the legal guarantee of conformity (articles L217-4 et seq. of the French Consumer Code ) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code ). In the event of non-conformity or a hidden defect, the customer may obtain a repair, an exchange, or a refund.

In the event of a defect or anomaly observed upon receipt of the order, the customer must contact FINESSE customer support within 72 hours :

After verification, a suitable solution will be offered (exchange or refund depending on availability).


9. Intellectual Property

All elements of the Site (texts, visuals, logo, name, products, graphics, etc.) are the exclusive property of FINESSE.
Any reproduction, exploitation or distribution, even partial, is strictly prohibited without prior written authorization.


10. Personal Data

The information collected during the ordering process is necessary for its processing and for managing the customer relationship.
They are processed in accordance with the Site's Privacy Policy .

The customer has the right to access, rectify and delete their personal data.


11. Applicable Law and Disputes

These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
In the absence of an agreement, the dispute will be brought before the competent courts.
